These Terms of Service (“Terms”) govern your access to and use of busylabour.com and related services (the “Services”) provided by Busy Labour (“Busy Labour”, “we”, “us”, or “our”). By registering a company account or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Until Busy Labour is incorporated, the Services are operated by Viktoriia Semerneva, Burnaby, British Columbia, Canada. If Busy Labour is later incorporated, these Terms will be updated with the company’s legal name and registered address.
1. Who may use the Services
You must be at least 16 years old and able to form a binding contract. If you register on behalf of a company, you confirm that you are authorised to bind that company to these Terms, and “you” refers to both you and that company.
2. Accounts and registration
To use certain features you must register a company account and provide accurate, complete, and current information, including a valid company name, contact person, email address, and phone number. You are responsible for keeping your password confidential and for all activity under your account. Notify us promptly at info@busylabour.com of any unauthorised use.
3. Account review and moderation
New company registrations are reviewed before they are published. We may approve, reject, suspend, or remove any account or content at our discretion, including where information is inaccurate, misleading, or violates these Terms.
4. Acceptable use
You agree not to:
- Provide false, misleading, or fraudulent information;
- Impersonate any person or company, or misrepresent your affiliation;
- Post unlawful, infringing, defamatory, or harmful content;
- Interfere with, disrupt, or attempt to gain unauthorised access to the Services or other users’ accounts;
- Use the Services to send spam or unsolicited communications;
- Scrape, harvest, or collect data from the Services except as expressly permitted.
5. Your content and worker information
You retain ownership of the information and content you submit (“Your Content”). You grant Busy Labour a non-exclusive, worldwide licence to host, store, display, and distribute Your Content as needed to operate and promote the Services. You are responsible for Your Content and confirm you have the rights to submit it.
Worker information. When you add a worker to the platform, you confirm that you have informed that worker their information is being provided to Busy Labour and that you have their consent to do so, as required by applicable privacy law. You are responsible for the accuracy of the information you enter about a worker and for keeping it current. You must not add a worker who has asked you not to, and you must tell us promptly if a worker withdraws consent.
We may contact a worker directly to confirm or act on a request they make to us about their own information, and we may remove a worker’s record at their request without your approval. We will notify you if we do. You agree to indemnify Busy Labour against any claim brought by a worker arising from information you provided about them without their consent or in an inaccurate form.
6. Intellectual property
The Services, including the Site’s design, text, graphics, and software, are owned by Busy Labour or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Services in accordance with these Terms. All rights not expressly granted are reserved.
7. Third-party links and services
The Services may contain links to third-party websites or services that we do not control. We are not responsible for their content, policies, or practices.
8. Termination
You may stop using the Services and delete your account at any time from your account settings. We may suspend or terminate your access at any time if you breach these Terms or if we discontinue the Services. Sections that by their nature should survive termination (including Sections 5, 6, 9, 10, and 11) will survive.
9. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, secure, or error-free, and we do not guarantee the accuracy of information provided by other users.
10. Limitation of liability
To the fullest extent permitted by law, Busy Labour will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Services. Nothing in these Terms excludes liability that cannot be excluded under applicable law (including certain rights of consumers in Canada and the United States).
11. Indemnification
You agree to indemnify and hold Busy Labour harmless from any claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Services, or your breach of these Terms.
12. Changes to the Services and Terms
We may modify the Services or these Terms at any time. We will post the updated Terms here with a new “Last updated” date and, where required, notify you. Your continued use of the Services after changes take effect means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable in it, without regard to conflict-of-law rules. Any disputes will be subject to the courts of British Columbia, unless mandatory local consumer-protection law provides otherwise.
